In lieu of an abstract, here is a brief excerpt of the content:Criminal Law, Pain Relief, and Physician Aid in DyingFaye Girsh, Ed.D., Executive DirectorMadam:The article by Cantor and Thomas on “Pain Relief, Acceleration of Death, and Criminal Law” (KIEJ, June 1996) was a tortured attempt to develop criteria for the humane and compassionate physician who tries to serve the needs of a patient in unremitting pain. There are three areas that merit comment.The authors dealt with pain medications that (...) might have the undesirable side effect of causing death. They did not mention tolerance, which usually occurs in a patient with chronic pain and which would require exceedingly high doses to be effective. They did not mention barbiturates, which are preferable to opiates in causing death and which are used increasingly by compassionate physicians to answer the pleas of their suffering patients, but for which there is no excuse about alleviating pain. Would the criminal law just call the prescription of a lethal dose of barbiturates a reckless act and require conviction? Fortunately, juries, as the authors point out, do not balance these formulas on the head of a pin. When they see the circumstances under which these doctors do help their patients, they choose to nullify the law and would ignore the suggestions made in this article.The authors refer to the “consent” of the patient. They do not mention that these doctors are operating with more than consent; they are administering these medications because suffering patients are begging them to put them out of their pain and the indignities of the dying process. The article discusses the process as though it were the same as consent to elective surgery. These patients—with AIDS, cancer, and hopeless neurological degeneration—are not simply agreeing to a procedure; they are desperately seeking a way out. If the criminal law were to develop criteria for physician aid in dying, certainly one of them should be the active, witnessed, repeated request of such a patient for a certain, quick, painless, gentle death.The third point is that physicians do not face prosecution when administering no treatment to a patient whose life could be saved with treatment but who chooses not to receive it. This has been upheld by the U.S. Supreme Court; no criteria for suffering, alternatives, terminality, justifiability, or unbearability are required. The doctor can stand by while the patient dies what may be a protracted, difficult death, but it is within the law. What matters in this situation is the decision of the patient to refuse treatment, and that is absolute. How ironic that the patient who cannot refuse treatment must, with his or her doctor, jump through all these hoops to achieve a peaceful death.One worries that the physician who must balance the risk of “risky pain relief” against the accusation of recklessness will err in the direction of allowing [End Page 103] the patient to bear the pain rather than help with a dose of analgesics that might be considered beyond the stipulated “risk.”Why don’t we just be honest about it? Allow dying or hopelessly ill patients to make the decision about what they want by passing a carefully defined law allowing euthanasia rather than balancing the risk and trying to determine the “purpose” of the physician’s ministrations. We protect some patients from themselves while allowing others almost complete autonomy to make the choice of ending their lives. Robert Baker and Laurence McCullough argue that the "applied ethics model" is deficient and in need of a replacement model. However, they supply no clear meaning to "applied ethics" and miss most of what is important in the literature on methodology that treats this question. The Baker-McCullough account of medical and applied ethics is a straw man that has had no influence in these fields or in philosophical ethics. The authors are also on shaky historical grounds in dealing with two (...) problems: (1) the historical source of the notion of "practical ethics" and (2) the historical source of and the assimilation of the term "autonomy" into applied philosophy and professional ethics. They mistakenly hold (1) that the expression "practical ethics" was first used in a publication by Thomas Percival and (2) that Kant is the primary historical source of the notion of autonomy as that notion is used in contemporary applied ethics. This paper has two distinct objectives. (1) I defend an analysis of the concept of a conflict of interest. On my analysis the concept of a conflict of interest is broader than is generally supposed. I argue that a very large class of cases not ordinarily regarded as conflicts of interest should be so regarded. Conflicts of interest are an integral feature of many professional relationships and do not (as is often supposed) require the existence of external financial or personal (...) relationships. (2) I defend and explain the commonsense view that conflicts of interest areprima facie wrong and argue that in ordinary cases it is wrong, all things considered, to allow an avoidable conflict of interest to occur. This paper presents an analysis of bluffing in labor negotiations from legal, economic, and ethical perspectives. It is argued that many forms of bluffing in labor negotiations are legal and economically advantageous, but that they typically constitute lying. Nevertheless it is argued that it is generally morally acceptable to bluff given a typical labor-management relationship where one's negotiating partner is familiar with and most likely employing bluffing tactics him/herself. We also consider whether it is an indictment of our present negotiating (...) practices and our economic system as a whole that, given the harsh realities of the marketplace, bluffing is usually morally acceptable. This paper examines several issues regarding deception in advertising. Some generally accepted definitions are considered and found to be inadequate. An alternative definition is proposed for legal/regulatory purposes and is related to a suggested definition of the term deception as it is used in everyday language. Based upon these definitions, suggestions are offered for detecting and regulating deception in advertising. This paper additionally considers the grounds for the generally held but largely unquestioned assumption that deceptive advertising is unethical. It is (...) argued that deceptive advertising can be shown to be morally objectionable, on the weak assumption that it is prima facie wrong to harm others. Finally, the implications of this analysis with respect to current regulation of deceptive advertising by the FTC are considered. (shrink)

I analyze a well-known and moving passage from John Steinbeck''s novelThe Grapes of Wrath. This passage provides an excellent illustration of one of the central questions about corporate moral agency: Is corporate moral agency anything over and above the agency of individual human beings? The passage in question is a debate about whether or not the actions of a particular company are anything over and above the actions of individual human beings.

With _Aristotle’s Teaching in the “Politics,” _Thomas L. Pangle offers a masterly new interpretation of this classic philosophical work. It is widely believed that the _Politics_ originated as a written record of a series of lectures given by Aristotle, and scholars have relied on that fact to explain seeming inconsistencies and instances of discontinuity throughout the text. Breaking from this tradition, Pangle makes the work’s origin his starting point, reconceiving the _Politics_ as the pedagogical tool of a master teacher. With (...) the _Politics_, Pangle argues, Aristotle seeks to lead his students down a deliberately difficult path of critical thinking about civic republican life. He adopts a Socratic approach, encouraging his students—and readers—to become active participants in a dialogue. Seen from this perspective, features of the work that have perplexed previous commentators become perfectly comprehensible as artful devices of a didactic approach. Ultimately, Pangle’s close and careful analysis shows that to understand the _Politics_, one must first appreciate how Aristotle’s rhetorical strategy is inextricably entwined with the subject of his work. What is freedom? In this study, Thomas Dumm challenges the conventions that have governed discussions and debates concerning modern freedom by bringing the work of Michel Foucault into dialogue with contemporary liberal thought. While Foucault has been widely understood to have characterized the modern era as being opposed to the realization of freedom, Dumm shows how this characterization conflates Foucault’s genealogy of discipline with his overall view of the practices of being free. Dumm demonstrates how Foucault’s critical genealogy does (...) not shrink from understanding the ways in which modern subjects are constrained and shaped by forces greater than themselves, but how it instead works through these constraints to provide, not simply a vision of liberation, but a joyous wisdom concerned with showing us, in his words, that we “are much freer than we feel.” Both as an introduction to Foucault and as an intervention in liberal theory, Michel Foucault and the Politics of Freedom is bound to change how we think about the limits and possibilities of freedom in late modernity. An important test of any moral theory is whether it can give a satisfactory account of moral prohibitions such as those against promise breaking and lying. Act-utilitarianism (hereafter utilitarianism) implies that any act can be justified if it results in the best consequences. Utilitarianism implies that it is sometimes morally right to break promises and tell lies. Few people find this result to be counterintuitive and very few are persuaded by Kant’s arguments that attempt to show that lying is always (...) wrong, even if it is necessary to save someone’s life. One thing that makes Kant’s view about lying so implausible is that he is committed to the view that the duty not to lie is always more important than any conflicting duties. Even if we agree with utilitarianism that lying and promise breaking are sometimes morally permissible, we may still be inclined to think that utilitarianism is too permissive about lying and promise breaking. Ross gives the definitive statement of this criticism. He holds that there is a strong, but overrridable, moral presumption against telling lies and breaking promises that is independent of utilitarian considerations. Almost all utilitarians claim that there is a strong moral presumption against telling lies and breaking promises on account of the direct and indirect bad consequences of those actions. However, utilitarians cannot say that there is any moral presumption against lying and promise breaking that is independent of their bad consequences. Many philosophers think that Ross’s theory constitutes a kind of reasonable middle ground in ethics between Kant’s absolutism and utilitarianism. Ross’s theory is arguably the major ethical theory that is closest to most people’s commonsense moral beliefs. Marr's levels of analysis—computational, algorithmic, and implementation—have served cognitive science well over the last 30 years. But the recent increase in the popularity of the computational level raises a new challenge: How do we begin to relate models at different levels of analysis? We propose that it is possible to define levels of analysis that lie between the computational and the algorithmic, providing a way to build a bridge between computational- and algorithmic-level models. The key idea is to push the (...) notion of rationality, often used in defining computational-level models, deeper toward the algorithmic level. We offer a simple recipe for reverse-engineering the mind's cognitive strategies by deriving optimal algorithms for a series of increasingly more realistic abstract computational architectures, which we call “resource-rational analysis.”. The Spirit of the Laws —Montesquieu’s huge, complex, and enormously influential work—is considered one of the central texts of the Enlightenment, laying the foundation for the liberally democratic political regimes that were to embody its values. In his penetrating analysis, Thomas L. The author has elsewhere defended the view that accepting a bribe involves the violation of an implicit or explicit promise or understanding associated with an office or position that one occupies and that therefore it is prima facie wrong to accept a bribe. Michael Philips has criticized this position in a recent paper. He argues that (a) there are cases in which accepting a bribe violates no promises or agreements, and (b) there are cases in which there is no prima (...) facie duty to refuse an offer of a bribe. The Life of Wisdom in Rousseau's "Reveries of the Solitary Walker" is the first complete exegesis and interpretation of Rousseau's final and culminating work, showing its full philosophic and moral teaching. The Reveries has been celebrated as a work of literature that is an acknowledged acme of French prose writing. Thomas L. Pangle argues that this aesthetic appreciation necessitates an in-depth interpretation of the writing's complex and multileveled intended teaching about the normatively best way of life—and how essential this (...) is for a work that was initially bewildering. Rousseau stands out among modern political philosophers in that he restored, to political philosophy, what Socrates and his students (from Plato and Xenophon through Aristotle and the Stoics and Cicero) had made central—and that the previous modern, Enlightenment philosophers had eclipsed: the study of the life and soul of the exemplary, independent sage, as possessor of "human wisdom." Rousseau made this again the supreme theme and source of norms for political philosophy and for humanity's moral as well as civic existence. In his analysis of The Reveries, Pangle uncovers Rousseau's most profound exploration and articulation of his own life, personality, soul, and thought as "the man of nature enlightened by reason." He describes, in Rousseau's final work, the fullest embodiment of the experiential wisdom from which flows and to which points Rousseau's political and moral philosophy, his theology, and his musical and literary art. With increasing awareness of environmental issues, there has been rising demand for environmental-friendly business practices. Prior research has shown that the implementation of environmental management practices is influenced by existing and potential stakeholder groups in the form of external pressures from legislators, environmental groups, financial institutions and suppliers, as well as internally by employees and owner/manager attitudes and knowledge. However, it has been reported that despite business owner/managers having strong “green” attitudes, the level of implementation of environmental-friendly practices is low. (...) In order to explore the connection between pressures for improved practices and the management actions taken, this article examines how influence from various stakeholders is related to awareness of environmental issues, and how this awareness relates to actions taken within the businesses to reduce the environmental impact of their operations. The results indicate that legislation does result in general environmental awareness, and that organizations are then willing to␣change their business processes and environmental strategies. However, despite their actions they have little awareness of the benefits that might arise from cost reductions from their environmental-friendly practices. Those influenced by their suppliers act to reduce waste, but do not put into place formal environmental management systems, or use environmental messages to market their goods or services. Nevertheless, it can be argued that they have a real commitment to environmental issues, as evidenced by a willingness to voluntarily contribute to environmental organizations. (shrink)

Despite a flurry of renewed scholarly interest in the development of Heisenberg’s scientific work, and in his complex relation to the dramatic unfolding of German cultural history in his time, there has yet to be executed a sustained and philosophically critical interpretative commentary on the book that is his crucial philosophical-ontological legacy, Physics and Philosophy: The Revolution in Modern Science. Given the profound ontological puzzles that continue to attend quantum physics and its implications for humanity’s past as well as present (...) and future conception of reality, such a critical exegesis of this text is overdue. No thinker has yet appeared who possesses such an authoritative combination of the decisively necessary learning, in quantum physics and in the historical development of philosophic ontology. This article tries to extricate the central nerve of Heisenberg’s sinuously unfolding, dialectical exposition, and in the process to elucidate its strengths but also its deep ambiguities and perplexities—which express fundamental dilemmas that pervade contemporary ontology. My interest in the issues considered here arose out of my great frustration in trying to attack the all-pervasive relativism of my students in introductory ethics courses at Virginia Polytechnic Institute and State University. I am grateful to my students for forcing me to take moral relativism and skepticism seriously and for compelling me to argue for my own dogmatically maintained version of moral objectivism. The result is before the reader. The conclusions reached here (which can be described either as (...) a minimal objectivism or as a moderate verson of relativism) are considerably weaker than those that I had expected and would have liked to have defended. I have arrived at these views kicking and screaming and have resisted them to the best of my ability. The arguments of this book are directed at those who deny that moral judgments can ever be correct (in any sense that is opposed to mistaken) and who also deny that we are ever rationally com pelled to accept one moral judgment as opposed to another. I have sought to take their views seriously and to fight them on their own grounds without making use of any assumptions that they would be unwilling to grant. My conclusion is that, while it is possible to refute the kind of extreme irrationalism that one often encounters, it is impossible to defend the kind of objectivist meta-ethical views that most of us want to hold, without begging the question against the non-objectivist. Languages are transmitted from person to person and generation to generation via a process of iterated learning: people learn a language from other people who once learned that language themselves. We analyze the consequences of iterated learning for learning algorithms based on the principles of Bayesian inference, assuming that learners compute a posterior distribution over languages by combining a prior (representing their inductive biases) with the evidence provided by linguistic data. We show that when learners sample languages from this posterior (...) distribution, iterated learning converges to a distribution over languages that is determined entirely by the prior. Under these conditions, iterated learning is a form of Gibbs sampling, a widely-used Markov chain Monte Carlo algorithm. The consequences of iterated learning are more complicated when learners choose the language with maximum posterior probability, being affected by both the prior of the learners and the amount of information transmitted between generations. We show that in this case, iterated learning corresponds to another statistical inference algorithm, a variant of the expectation-maximization (EM) algorithm. These results clarify the role of iterated learning in explanations of linguistic universals and provide a formal connection between constraints on language acquisition and the languages that come to be spoken, suggesting that information transmitted via iterated learning will ultimately come to mirror the minds of the learners. Situation selection involves choosing situations based on their likely emotional impact and may be less cognitively taxing or challenging to implement compared to other strategies for regulating emotion, which require people to regulate their emotions “in the moment”; we thus predicted that individuals who chronically experience intense emotions or who are not particularly competent at employing other emotion regulation strategies would be especially likely to benefit from situation selection. Consistent with this idea, we found that the use of situation selection (...) interacted with individual differences in emotional reactivity and competence at emotion regulation to predict emotional outcomes in both a correlational and an experimental field study. Taken together, the findings suggest that situation selection is an effective strategy for regulating emotions, especially for individuals who otherwise struggle to do so. (shrink)
